The Principal Judge, Dr. Flavian Zeija in the High Court has thrown out an application in which 45 students of Kyambogo University sought to halt next week’s graduation ceremony after it was found out that the affidavit to support the application was not made before the commissioner of oaths as required by the law.

The students led by Kenneth Masereka on Tuesday this week ran to the high court in the interest of seeking a court order to stop the preparations of the 17th graduation ceremony slated for September 21st to September 23rd 2021 until they are included on the graduation list.

 

The students through their lawyers of Joel Cox Advocates said that they will suffer irreparable damages if the court doesn’t halt the graduation ceremony saying the decision to exclude them from the list is illegal, oppressive, arbitrary, biased, high handed, irrational, unfair and a breach of the fundamental right to be heard and thus the same is null and void.

However Justice Zeija’s ruling has depended on the university lawyer Cyrus Baguma who asked court to throw out the application since the lone affidavit being relied on by the students was not sworn in accordance with the law and that it didn’t have a date.

It was reported that results and data for over 2700 students had been deleted from the university system by allegedly former ICT staff of the university and Prof. Elly Katunguka, the Kyambogo University Vice Chancellor confirmed the challenge where among those affected are graduands who are around 200.

Speaking to journalists shortly after court, Kyambogo University spokesperson, Ruben Twinomujuni said the graduation of 9536 students will now go on in peace next week.
