The High Court Criminal Division in Kampala has set 17th August 2023 for mention of the case filed by Hassan Male Mabirizi against Gen. Muhoozi Kainerugaba and seven others.

In this case, Mabirizi is accusing Gen. Kainerugaba and seven leaders of the MK Movement for disobedience of statutory duty, common nuisance, scandalous conduct and conspiracy to commit misdemeanors.

The suspects added on the charge sheet include; David Kabanda, Andrew Mujuni Mwenda, Balaam Barugahare Ateenyi, Michael Mawanda Maranga, Michael Nuwagira Kaguta alias Toyota, Lilian Aber and Michael Katungi.

Yesterday, the High Court summoned them to appear for the ruling in Mabirizi’s application against the Buganda Road Court for proceeding with his case and transferring it from the City Hall Court.

For that matter, the High Court Registrar Festo Nsenga has apologized and said that there was an error.

On Wednesday, the accused’s lawyer, Fred Mukasa Mbidde and the applicant Mabirizi appeared before Nsenga who asked Mabirizi to file his submissions on 7th August and defense lawyers to respond on 11th August 2023.

In the suit filed on 22 November 2022, Mabirizi alleged that Kainerugaba addressed a political gathering at Kololo Independence Grounds in Kampala Central Division without resigning from the Uganda People’s Defense Forces (UPDF).

According to Mabirizi, this act contravenes Section 99 of the UPDF Act, which prohibits serving military personnel from engaging in political activities.

Although the case was over taken by prosecution on 14th November 2022, this saw Mabirizi making amendments by adding six more suspects and four charges on 13th July 2023.
