The Supreme Court Judge Opio Aweri has adjourned the Age Limit review case filed by Lawyer Male Mabirizi Kiwanuka to the next convenient session.

 

This was after the parties in the case informed him that they will not be available on April 2nd 2020, the date he had scheduled for them to return to court for hearing.

 

Both Mabirizi and the Attorney General’s representative State Attorney Wanyama Kodoli said they will be in the East African Court of Justice to handle a related case which forced the Judge to push it to the next convenient session.

 

Mabirizi went to Supreme Court and raised 42 grounds challenging Supreme Court verdict on the consolidated appeals against the presidential age limit removal of which one was about the Chief Justice Bart Katureebe who he said was not fit to give judgment in the matter because he was not fine health wise since he had spent two weeks on a sick leave and further that he is a friend to the president of Uganda and there is no way he would have ruled against him.

 

On April 18th, 2019, a panel of seven Supreme Court justices upheld the constitutional court judgment in a verdict of 4-3, saying the constitutional amendment number 2 bill of 2017 was validly passed and those who delivered judgments in favor of the law included Chief Justice Bart Katureebe, Jotham Tumwesigye, Apio Aweri and Stellah Arach Amoko while Justices Lillian Tibatemwa, Paul Mugamba and Eldard Mwanguhya, said the entire process leading to the passing of the bill was characterized by irregularities including violence, failure to consult citizens and absence of certificate of compliance.

 

This prompted Mabirizi who was one of the petitioners in the consolidated appeal to run to the Supreme Court demanding for a review of the Judgment.
