The Supreme Court of Kenya has upheld the presidential election results in which the Independent Electoral and Boundaries Commission IEBC declared William Ruto winner of the August 9 polls.

 

The official results released by the commission showed that Ruto, currently the deputy president of Kenya won the hotly contested race with 7,176,141 votes, representing 50.49 of the total votes cast while Raila Odinga secured only 6,942,930 translating to 48.85 per cent of the vote.

Ruto’s main rival, Raila Odinga, and eight others challenged the win allegedly on grounds that there was massive fraud, including tampering with results forms, technology, failure to attain 50%+1 and postponement of elections in some parts of the country purportedly said to be their strong holds.

According to the final ruling read this afternoon by the Kenyan Supreme Court don Justice Martha Koome after a unanimous decision by the seven benches of Justices, said that they found no persuasive or credible evidence to support the petitioner’s claims to nullify the presidential election of 9th August 2022.

CJ Koome added that the allegation that IEBC used a tool to tamper with forms 34A was sufficiently explained when IEBC demonstrated how the KIEMS tools captured and transmitted the image.

On whether Venezuelan national Jose Carmago accessed the electronic system and interfered with the results as presented to the court by lawyer Julie Soweto, the Chief Justice said that it turned out to be no more than hot air and that the court was instead taken on a wild goose chase that yielded nothing of value.

CJ Koome said the decision to uphold the presidential election result was a unanimous decision that Ruto received 50.9% and Odinga 48.85% and a more detailed judgment would be issued later.
