The Constitutional Court has dismissed a petition that was filed by former Bubulo West Member of Parliament Tony Nsubuga Kipoi after his lawyer presented an expired practicing certificate. 

 

The petition has been dismissed by a panel of five judges led by Kenneth Kakuru of which Kipoi in his petition was challenging the provisions under the Uganda People’s Defense Forces Act which provide that civilians once found with military weapons can be subjected to military law.

 

Kipoi’s lawyer Retired Major Ronald Iduuli failed to present a valid practicing certificate but said it could not be renewed because of the prevailing conditions of COVID-19 and prayed that court proceeds since he is a credible person who has been in service for 8 years but the judge objected to it until a he gets a valid license.

 

Later Oduuli complained through the media that the judges didn’t rule instead of dismissing the petition they would have requested for another lawyer from his company.

 

Kipoi  was extradited from Botswana in March 2018 after he had reportedly conned unsuspecting number of Botswana pretending to be a Witch Doctor and later charged before the court martial on charges related to security and challenged his his trial in the high court saying that the military court lacked jurisdiction to try him as a civilian among other reasons but his case was dismissed by Justice Musa Ssekaana however his lawyer reinstated it in the Constitutional Court.

 

Kipoi was released on bail in june 2019 by the court martial.
