A Kampala Businessman Hamis Kiggundu has been ordered to file a fresh case before the High court where he is contesting the action by Diamond Trust Bank Uganda/Kenya of withdrawing Ush 120 billion from his account illegally.

 

Kiggundu, the proprietor of Ham Enterprises Limited and Kiggs International (U) limited dragged DTB -Uganda, and DTB-Kenya to Commercial Court in Kampala for allegedly withdrawing over Ush120 billion from his accounts which he wants to be refunded.

 

The bank however appealed against the judgment of the Commercial court on grounds that there was no illegality committed contrary to the Financial Institution Act and in May this year a panel of three justices of the Court of Appeal including Richard Butera, Kenneth Kakuru and Christopher Madrama ruled in favor of the Diamond Trust Bank, setting aside the High Court ruling.

 

The Appellant court ordered for a retrial of the case by the Commercial Court, prompting the businessman to run to the Supreme Court to appeal against the decision of the Court of Appeal.

 

However, the Supreme Court today under Justice Percy Tuhaise said DTB bank is operating legally although it doesn’t have a license per now and ordered Ham to pay 50% of the court costs to DTB and file again through the high court indicating that he borrowed money from the DTB.

 

Shortly after the court process lawyers representing Ham led by Friday Kagolo talked to the media expressing their dissatisfaction over how the court has handled their case.
