Court of Appeal Judge Christopher Madrama has declined to grant lawyer Hassan Male Mabirizi release from prison.

 

Justice Madram said that the stay of execution Mabiriizi was seeking of not being taken to prison pending the determination of his appeal challenging the 18 months sentence for contempt of was already overtaken by events.

 

Mabirizi had pleaded to the court to at least grant him a review in the matter where he was sentenced to 18 months in prison.

 

Mabirizi who was in court physically upon hearing the judge’s ruling, he didn’t  wait for his lawyer Isaac Ssemakadde to respond than he immediately stood up and pleaded to the judge to grant him a temporary release since he is a citizen and ready to abide by the court orders.

 

However, the State Attorney Patricia Mutesi objected to his plea and asked court to maintain its ruling.

 

Mabirizi was on February 15th 2022 found in contempt of Court for the second time over attacking judicial officers using his social media platforms, after several warnings over the same offences by the Civil Division Judge Musa Ssekaana on January 27th 2022.

 

However, Mabirizi appealed against the case in the Court of Appeal on grounds that he was never given a right to fair hearing and that there is no way how Justice Ssekaana could have presided over the Attorney General’s application since he was among the judicial officers that Mabirizi had reportedly abused on social media.

 

Mabirizi also filed an application seeking to halt the decision to have him arrested pending the determination of his appeal challenging the legality of the sentence given to him.
