The former Forum Democratic Change-FDC party president Kiiza Besigye and former Rubaga South Parliamentary candidate, Samuel Lubega Mukaaku have vowed not to report back at Buganda road court for hearing of their matter if in the next court session the state prosecutor doesn’t work on his personal conduct.

 

The duo had on Wednesday appeared in court for further hearing of their incitement to violence case where they are accused of staging an Illegal assembly in Kampala last year but court couldn’t proceed after the State Prosecutor around (Jean Nayebare) revealing to court that the state prosecutor who is responsible for the matter Ivan Kyazze was on leave and as such she prayed for an adjournment until when he comes back.

 

The accused through their lawyer Erias Lukwago were surprised noting that this was an injustice aimed at keeping them in court something they are not ready to accept. They contend that if such a report happens come the next court session on 22nd February, they will not report back to the same court.

 

He further said that incase a state prosecutor is on leave he or she ought to put up measures to enable further proceeding of the case as it is required for a public servant.

 

Prosecution accuses Dr. Besigye and Mukaaku of staging an illegal assembly in Kikuubo Shauriyako parish, Kampala Central Division where they allegedly made statements indicating that it would be desirable to demonstrate with the aim of causing damage and destruction to property and this their assembly was based on the skyrocketing commodity prices, which nearly doubled in less than a year.
