The Civil Division of High Court has dismissed an application in which Assistant Commissioner of Police Siraje Bakaleke wanted to proceed without the respondent in an application seeking to block his trial before the Anti-Corruption Court.

Bakaleke through his lawyer Sarah Nakachwa on October 2nd 2018 filed an application where he wanted court to precede in the absence of the Attorney General the respondent because he had not filed submissions to show that he was interested in the main case which also seeks to block the fraud trial.

Bakaleke is charged of fraud, conspiracy to commit a felony, kidnap, abuse of office and obtaining money by false pretence along with eight others who include; Paul Wanyoto Mugoya, Nabeta Samuel Mulowooza, the Managing Director Eye Power Engineering Company and Police Officers Robert Munezero, Innocent Nuwagaba, Robert Ray Asiimwe, Junior Amanya, Babu Gastavas and Kenneth Zirintuusa.

They are accused of extorting US$ 1.5million (about Shillings 1.4 billion) from Park Seunghoon and Jang Shingu Un, both South Korean nationals who had come to Uganda to buy Gold early this year.

Justice Musa Sekaana dismissed Bakaleke’s application with costs saying, that a representative from the Attorney General filed an affidavit in reply an indication that the Attorney General was already interested to take on the main application.

Sekaana dismissed the case with costs which left Nakachwa in tears and yet she has to file written submissions on the case by 29th this month and the Attorney General by November 7th to aid his ruling expected to be delivered on December 21st.
