City lawyer Hassan Male Mabirizi has petitioned the Supreme Court seeking to stop the delivery of detailed rulings arising from the Presidential Election Petition filed by the former Presidential Candidate Robert Kyagulanyi Ssentamu.

 

Mabirizi in his petition received by the Supreme Court officials a few minutes ago in the Registry wants the delivery blocked until the determination of his application seeking to stay all the proceedings arising from the petition.

 

This application which is also pending at the Supreme Court wants the proceedings halted until the determination of Mabirizi’s case before the East African Court of Justice challenging Chief Justice Owiny-Dollo’s decision not to rescue him from presiding over the proceeding.

 

A panel of nine Supreme Court Justices led by Chief Justice Owiny-Dollo is expected to sit today and deliver a detailed ruling, on why chief justice as a person refused to step down from presiding over the petition as first asked by Mabirizi.

 

Mabirizi had previously asked Owiny-Dollo to excuse himself from the case on grounds that he was not going to give justice in the matter having been Museveni’s lawyer in the Presidential Election Petition filed by Dr Kiiza Besigye in 2006.

 

However chief justice Owiny- Dollo declined to step aside and didn’t give reasons which forced Mabirizi to challenge his decision in the East African Court of Justice which has not yet determined the matter.

 

Mabirizi also does not want the same court to deliver a detailed ruling of why it allowed Kyagulanyi to withdraw his petition as a whole plus the details of whether each party in the matter should bear its costs as prayed by the applicant.

 

The above ruling is meant to be delivered tomorrow.
