The High Court in Nabweru has declared George Musisi the duly elected Member of Parliament for Kira Municipality, paving the way for his election rival, Daniel Kananura, to withdraw a petition challenging the outcome of the 2026 parliamentary election.
Presiding over the case, Justice George Okello granted Kananura leave to withdraw the petition, bringing an end to the legal challenge against Musisi’s victory.
Speaking after the court proceedings, Musisi said the case had wasted time and resources that could otherwise have been dedicated to serving the people of Kira Municipality. He argued that Kananura had failed to present sufficient evidence to substantiate his allegations of electoral malpractice.
Musisi also dismissed Kananura’s explanation that his former lawyers had failed to present adequate evidence, insisting that the petitioner had been given sufficient time and opportunity to prove his claims.
Although the court declined to award Musisi additional costs arising from the withdrawal application, the MP said he respected the decision.
The court directed both parties to bear their own costs in the application. Musisi’s lawyer, Elias Nalukoola, explained that the judge had taken into account costs Kananura had previously been ordered to pay in a separate application.
In his petition, Kananura had alleged that the election was marred by violence, intimidation, voter bribery, vote rigging and other irregularities. He also accused Musisi of conspiring with polling agents and Electoral Commission officials to falsify election results.
Kananura further contended that the results recorded on declaration of results forms and other electoral documents did not reflect the actual votes obtained by the candidates.
He had asked the court to nullify Musisi’s election and declare him the duly elected MP or, alternatively, order a fresh election.
However, in an application filed on October 8, 2026, Kananura informed the court that, following further reflection and consultations, he had decided not to proceed with the petition.
Musisi will therefore continue representing Kira Municipality in the 12th Parliament following the withdrawal of the legal challenge to his election.
