Tensions Rise in Besigye Treason Case

Pre-hearing proceedings in the treason case involving opposition leader Kizza Besigye on Wednesday resumed at the High Court in Kampala, with the defence continuing its cross-examination of Chief State Attorney Joseph Kyomuhendo.

The session, presided over by Emmanuel Baguma, featured a high-profile legal team.

The defence includes Martha Karua, Erias Lukwago, Fredrick Mpanga, and Ernest Kalibaala, while the State is represented by prosecutors Thomas Jatiko and Richard Birivumbuka.

Justice Baguma directed that the cross-examination be concluded within today and tomorrow, citing scheduling constraints.

During the hearing, defence lawyer Lukwago pressed Kyomuhendo over alleged electronic threats referenced in an affidavit supporting the State’s request to conceal the identities of six witnesses.

Kyomuhendo acknowledged the threats but said he had no supporting records before court and declined to identify who analyzed or documented them.

Tensions escalated as the defence demanded details on the forensic sources, while the prosecution objected, arguing such questioning could expose or intimidate witnesses.

The judge intervened, directing that responses be limited to “yes” or “no” where appropriate and formally noting instances where the witness declined to answer.

Kyomuhendo further testified that the alleged threats were issued through an individual identified as Frank Kiherere on behalf of the accused, though he could not recall specific dates.

The State is seeking to conceal the identities of six witnesses, arguing that disclosure could endanger them.

Proposed measures such as audio-visual testimony and voice distortion were outlined, but Kyomuhendo indicated these may not be suitable in this case.

The defence opposed the application, arguing it lacks a clear legal foundation and warning it could lead to what they described as “trial by ambush.”

Dr. Besigye, alongside Obeid Lutale and Denis Oola Oyaa, faces charges linked to an alleged plot to overthrow the government.

Proceedings are ongoing.
