Parliament Faces 41 Court Cases Over Procedural Lapses, MPs Warned on Legal Compliance

Parliament is currently handling 41 active court cases, largely attributed to non-compliance with laws and parliamentary procedures, according to its Legal Department.

The disclosure was made during an induction session for Members of Parliament at Munyonyo, where legislators were urged to strictly adhere to legal requirements and the Rules of Procedure in order to protect Parliament’s reputation and reduce the loss of public funds through litigation.

The warning was issued by Solomon Kirunda, Director of Legal and Advisory Services, who cautioned that parliamentary work, including committee investigations and legislative processes, can easily be nullified if procedural requirements are not properly followed.

Kirunda emphasized that parliamentary success is not only determined by good intentions but also by accurate record-keeping and strict compliance with established procedures that can withstand judicial scrutiny.

He cited the 2017 Constitutional Amendment Bill court petition, in which judges questioned whether the motion for the Bill’s second reading had been properly seconded.

Although Parliament argued that members had seconded it by rising in the House, the court required formal evidence in the Rules of Procedure or official records.

Following that ruling, Kirunda said Parliament began formally recording the names of MPs who second motions to ensure compliance and avoid similar legal challenges in the future.

He cautioned lawmakers that failure to observe procedural requirements continues to expose Parliament to avoidable legal disputes and financial risks.
