The Court of Appeal has postponed the hearing of an election petition filed by Kawempe North Member of Parliament, Elias Luyimbazi Nalukoola, after he failed to meet a court-imposed deadline for filing critical documents.
Deputy Registrar Jane Mugala had instructed Nalukoola to submit his prejudicial submissions by September 2.
However, his legal counsel, Remmy Bagenda, requested an extension, citing the voluminous nature of the case file and the heavy workload involved in compiling the necessary materials.
In response, the court has issued new procedural guidelines and extended the deadline for submissions to November 11, giving all parties more time to prepare.
Nalukoola is appealing a High Court ruling that nullified his election on grounds of voter disenfranchisement and illegal campaigning on polling day.
The High Court ordered a fresh by-election, a decision Nalukoola is contesting.
In his appeal, he accuses Justice Bernard Namanya of failing to properly evaluate the evidence presented during the original trial.
The case will proceed once all parties comply with the revised court deadlines.
