Parliament Approves Introduction of Kadhi Courts Bill

Parliament has granted leave to Bugiri Municipality MP, Asuman Basalirwa, to introduce a Private Member’s Bill titled The Kadhi Courts Bill, aimed at formalizing an Islamic justice system for Uganda’s Muslim community.

Basalirwa presented his motion on the floor of Parliament and was seconded by Mbale Industrial Division MP, Karim Masaba, and Butambala County MP, Aisha Kabanda.

He noted that Uganda is not the first country to have Kadhi courts, which are already informally operational in the country.

These courts handle matters such as marriage, divorce, and inheritance within Muslim communities.

Basalirwa argued that formalizing Kadhi courts through legislation would provide a clear legal framework, ensure consistency in justice administration, and strengthen access to justice for Muslims.

He further emphasized that Kadhi courts have been effective and accessible in resolving family and civil disputes, and institutionalizing them would enhance their legitimacy and accountability.
