The High Court in Kampala, presided over by Justice Bernard Namanya, has nullified the election of Elias Luyimbazi Nalukoola of the National Unity Platform (NUP) as Member of Parliament for Kawempe North and directed the Electoral Commission to organize a fresh election.
Delivering the ruling this afternoon, Justice Namanya stated that the by-election held on March 13th this year failed to comply with the provisions of the Parliamentary Elections Act, a failure that significantly affected the integrity and outcome of the poll.
The court found that over 16,640 eligible voters in the constituency were denied the opportunity to cast their ballots, including NRM’s candidate Faridah Nambi Kigongo. This disenfranchisement, the judge noted, compromised the fairness of the election.
Justice Namanya also faulted Nalukoola for engaging in illegal campaigning on polling day.
According to the ruling, he was seen canvassing for votes at Kawempe Mbogo Primary School playground and Kazo Angola polling station—an act that contravenes sections 100(1)(b), 100(2), and 100(3) of the Parliamentary Elections Act (Cap 177).
In response to the ruling, Nalukoola’s lawyers have indicated their intention to appeal.
At the time of the judgment, Nalukoola was reported to be abroad on a holy pilgrimage.
