Lawyers representing Dr. Kizza Besigye and his co-accused Haji Obeid Lutale Kamulageya have insisted that their client wants to get a Constitutional Court interpretation on a number of laws that are misinterpreted in the General Court Martial.
They contend that the Court Martial being headed by the UPDF which is the complainant at the same time trying and taking judgment cannot give fair justice to their clients.
On Tuesday morning, the Military Court dismissed all objections from the defense saying that the Court Martial has capacity to try the case.
On Monday, the Military Prosecutors at the Court added a treachery charge against Dr. Besigye and Lutale, who were initially facing charges of unlawful possession of ammunition and firearms and the court asked the accused to take the plea which the defense objected to.
Part of the reasons for the objections was that the two accused Besigye and Lutale are not serving UPDF officers to be charged in the military court and that the way they were brought back in Uganda from Kenya after their arrest was unlawful.
On Monday the prosecutors amended the charges against Besigye and Lutale, and also added a new suspect, Captain Denis Oula, a serving UPDF Officer attached to the Armoured Brigade.
The Court heard that between February 2023 and November 2024, Besigye, Lutale and, Captain Oula allegedly held meetings in Geneva, Athens, Nairobi, and various locations in Uganda.
The meetings were reportedly aimed at soliciting logistical support and identifying military targets with intent to undermine the security of the Defense Forces.
