A family whose relative was knocked dead by a speeding vehicle belonging to the former Speaker of the East African Legislative Assembly, Daniel Fred Kidega is in court seeking compensation.

The deceased, Francis Nakibinge was reportedly knocked dead on March 8, by a speeding vehicle registration number TCD 694. The accident reportedly took place at the Namboole Stadium Roundabout.

His family led by Gerald Sebandeke states that Kidega’s driver Elvis Kinene negligently drove the said vehicle at a high speed and lost control, swerving off the road into the opposite lane and ran over a motorcycle which Nakibinge was riding. The same motorcycle had a passenger who sustained serious injuries from the accident.

The family notes that subsequent investigations by Bweyogerere Police Station indicated that Kinene was driving negligently without due regard to other road users. They now contend that Kidega is vicariously liable for the acts of his driver and should thus pay them compensation for having caused Nakibinge’s death and yet she was their breadwinner.

The family says that they have since suffered emotional and financial loss, valuing their burial expenses at 15 million Shillings and replacing the deceased’s motorcycle at 4.5 million Shillings. They valued the suit before the High Court at 50 million shillings.

Now, the family wants a court order directing the defendants jointly and individually to compensate the plaintiff with 19 million Shillings as special damages, and compensation for loss of life as well as the costs of the suit.

Kidega and Kinene have since been summoned to file their defence before the suit is allocated to the Judge who will be fixing it for hearing.
